Terms

These terms are between you and Lucro Limited, a company registered in Ireland, company number 811725. Using Logomark means you accept them.

What Logomark does

Logomark connects to your Stripe account with a read only key, identifies your customers, finds their logos from their own public websites, gives you a link to ask their permission, records their answer, and publishes the approved logos as a wall you can embed on your site.

Your account

• You must be at least 18 and able to enter a contract
• You are responsible for anything done through your account
• Sign in is by one time email link, so keep control of your email address
• One account per business. Do not resell access

Trial and payment

• The trial runs for 14 days. We take a card at the start, and charge nothing until it ends
• After the trial it is $29 per month, billed monthly in advance
• Cancel any time through the billing portal. You keep access until the end of the period you paid for
• We do not give refunds for partial months, but if something goes badly wrong, email us and we will sort it out
• If we change the price, existing customers get 30 days notice and keep their rate until then

If your payment fails

Your published wall stays live and keeps serving. The dashboard stops updating and you cannot send new requests. We are not going to make logos vanish from your homepage because a card expired.

Your responsibilities, and this part matters

Logomark helps you ask for permission. It does not grant permission, and it does not make you compliant. You are responsible for:

• Having a lawful basis to contact the people in your Stripe account
• Complying with GDPR, PECR, CAN-SPAM and any other rules that apply where you and your customers are
• Not using a logo that has not been approved through the service
• Removing a logo promptly if its owner asks you directly rather than through us
• The accuracy of anything you send in your own name

You are the data controller for your customers' information. We are your processor. Our privacy policy sets out what that means in practice.

What you must not do

• Use it to send unsolicited bulk email to people who are not your customers
• Import a purchased or scraped list and present it as your subscriber base
• Publish a logo whose owner declined, or whose approval you know is out of date
• Try to reach parts of the service you are not authorised for, or interfere with other users
• Resell, sublicense or white label the service without our written agreement

We may suspend an account that does any of this. Where we can, we will ask first.

Logos and consent records

Logos belong to the companies they identify. Nothing in the service transfers any right in a trademark to you or to us.

Consent records are yours. If you leave, you can export them. We keep our own copy for six years, because a record that can be deleted by the party relying on it is not a record.

A logo owner can revoke at any time using the permanent link in their approval email. When they do, it comes off your wall the same day and there is nothing you or we need to do about it.

Availability

We try to keep it up and we have built it so that published walls keep serving even when our own systems are not. We do not promise a specific uptime figure and there is no SLA on the $29 plan. We may take the service down for maintenance and will avoid doing it at stupid times.

Liability

Logomark is provided as is. To the extent the law allows, we are not liable for indirect or consequential loss, lost profits, or lost business.

Where we are liable, our total liability is capped at what you paid us in the 12 months before the claim.

Nothing here limits liability for death, personal injury, fraud, or anything else that cannot lawfully be limited.

Ending it

• You can close your account any time from the billing portal
• We can end it with 30 days notice, or immediately if you breach these terms
• On closure, your published wall stops serving and your customers' data is deleted within 30 days
• Export your consent records before you close if you want to keep them

Not affiliated with Stripe

Logomark is an independent product built by Lucro Limited. We are not affiliated with, endorsed by, sponsored by or otherwise connected to Stripe, Inc. Stripe is a trademark of Stripe, Inc. We use their publicly documented API as any developer may. Your relationship with Stripe is governed by your own agreement with them, and any problem with your Stripe account is between you and Stripe.

The same goes for every other company whose logo may appear through the service. Their appearance means a person at that company approved it, and nothing more.

Law

These terms are governed by the laws of Ireland, and the Irish courts have exclusive jurisdiction. If you are a consumer rather than a business, this does not take away rights you have where you live.

Changes

We will email you 30 days before any material change. Continuing to use the service after that means you accept the new version.
